TERMS OF USE – HELP MY MIND
1. Acceptance and Applicable Documents
By accessing, registering for, or using Help My Mind ("Platform" or "Service"), you explicitly and bindingly agree to these Terms of Use, our Privacy Policy, our Child Safety Standards, and any applicable supplementary guidelines or Community Codes of Conduct. If you do not agree to any provision, you must immediately discontinue use of the Platform. In the event of a conflict between specific community rules and these Terms, these Terms of Use shall prevail.
2. Eligibility, Minors, and Child Safety Standards
Use of the Platform is restricted to individuals at least 14 (fourteen) years of age. Users between 14 and 18 years of age declare that they are using the Service under the direct supervision, consent, and legal responsibility of their parents or legal guardians. Help My Mind reserves the right to request proof of age at any time and to suspend or terminate non-compliant accounts, in alignment with GDPR, CCPA, and LGPD. In strict alignment with our Child Safety Standards, Help My Mind enforces an absolute zero-tolerance policy against any form of Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). Violations result in immediate permanent account termination, irrevocable content removal, and formal reporting to law enforcement authorities (including NCMEC and the Federal Police). We maintain a prioritized channel for child safety inquiries: safety@helpmymind.com.br.
4. Crises, Imminent Danger and Emergencies
We do not monitor all content in real time and assume no legal duty to intervene in urgent situations. IN CASE OF IMMEDIATE RISK TO LIFE, SUICIDAL THOUGHTS, OR EMERGENCIES, YOU MUST IMMEDIATELY CONTACT LOCAL EMERGENCY SERVICES (e.g., 911 in the USA, 112 in Europe, 192/188 in Brazil). Publishing instructions that encourage suicide, self-harm, or hazardous challenges is strictly prohibited.
5. Accounts, Security, and Responsibility
You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify Help My Mind immediately of any unauthorized access. The Platform is not liable for losses arising from your failure to maintain account security. Selling, licensing, transferring accounts, or impersonating others is strictly prohibited.
6. Content Ownership and License
You retain intellectual property rights in the content you submit. However, by publishing it, you grant Help My Mind a worldwide, non-exclusive, irrevocable, royalty-free, sublicensable license to host, store, reproduce, adapt (for technical purposes), display, distribute, and translate such content to operate, promote, and improve the Services.
7. "Anonymous Venting" and Technical Boundaries
The "Anonymous Venting" feature conceals your identity from other users on public interfaces. However, the Platform uses commercially reasonable security measures and cannot guarantee absolute technical anonymity. Connection logs and authorship records are retained for statutory compliance, abuse mitigation, and cooperation with law enforcement investigations.
8. Communities and Moderation
Moderation tools are provided to assist in maintaining a safe environment, but Help My Mind does not pre-screen all content and assumes no liability for opinions or actions of users, creators, or volunteer moderators (who are independent users, not employees or legal agents of the Platform). We reserve the right to remove content, suspend accounts, or revise rules at our sole discretion.
9. Direct Messages and External Interactions
Help My Mind acts solely as a technological intermediary. We do not participate in, control, or guarantee the safety of off-platform communications, financial transactions, or in-person meetings. Any interaction occurs entirely at your own risk.
10. Independent Professional Directory (Marketplace Disclaimer)
The professional directory is provided for informational discovery purposes only. Help My Mind does not guarantee the ongoing validity of professional licenses, clinical qualifications, or ethical conduct. Users must independently verify credentials with relevant licensing boards.
11. Strictly Prohibited Conduct
You may not use the Platform to: (a) engage in any form of Child Sexual Abuse and Exploitation (CSAE), produce, solicit, store, or transmit Child Sexual Abuse Material (CSAM), engage in child sexual grooming, sexual extortion (sextortion), or harass, discriminate against, or exploit minors; (b) promote unlawful "cures" or hazardous medical misinformation; (c) infringe intellectual property or third-party privacy rights (including doxing); (d) engage in data scraping, reverse engineering, malware distribution, or vulnerability exploitation; (e) send spam or fraudulent schemes.
12. Subscriptions, Payments, and In-App Purchases
Premium features are offered on an "as available" basis. Pricing and auto-renewal terms are disclosed prior to purchase. Unless required by mandatory statutory consumer law, all purchases are final and non-refundable. Subscriptions processed through Apple App Store or Google Play are subject exclusively to their respective terms and refund policies.
13. Platform Intellectual Property
Help My Mind, its brand names, trademarks, source code, designs, and visual assets (including Premium avatar items) are the exclusive property of the Platform or its licensors. Users receive a limited, revocable, personal, and non-commercial license of use.
14. Indemnification
You agree to defend, indemnify, and hold harmless Help My Mind, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and reasonable legal expenses arising out of: (a) your improper use of or access to the Platform; (b) your violation of these Terms; or (c) your infringement of third-party rights.
15. LIMITATION OF LIABILITY AND DISCLAIMERS (AS IS / AS AVAILABLE)
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". HELP MY MIND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VULNERABILITIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HELP MY MIND BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO HELP MY MIND IN THE PAST 12 MONTHS OR USD $100.00, WHICHEVER IS GREATER.
16. Termination and Modifications
Help My Mind reserves the right to modify these Terms or suspend services at any time. Substantial revisions will be communicated through appropriate channels. Your continued use constitutes acceptance. You may terminate this agreement at any time by deleting your account.
17. General Provisions
Severability: If any provision is deemed unlawful or unenforceable by a court of competent jurisdiction, that provision shall be limited to the minimum extent necessary, and the remaining provisions shall remain in full force. Survival: Provisions regarding Intellectual Property, Medical Disclaimers, Indemnity, Limitations of Liability, and Governing Law survive termination.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to conflict of law principles. The courts of Rio de Janeiro/RJ, Brazil, shall have jurisdiction, without prejudice to non-waivable statutory consumer protections available in your domicile jurisdiction.
