Help My Mind acts as the primary Data Controller for the purposes described herein. Third-party services accessed through links or media embeds (such as app stores and the Spotify player) operate under their own independent privacy notices. Help My Mind exercises no control over and disclaims liability for third-party data processing.
2. Data We Collect (Minimization and Purpose)
We strictly collect information necessary to operate the platform, including: Account Information: Name or handle, email address, age group, and encrypted credentials. Interaction Data: Profile settings, avatars, interface preferences (such as Focus tool settings), reactions, and report history. User-Generated Content: Posts, venting stories, comments, direct messages, and attachments. Directory Profiles (Independent Professionals): Qualifications, credentials, approximate location, and public contact information. Transaction Records: Subscription and transaction proofs provided by app stores (Help My Mind does not store full credit card numbers). Technical and Telemetry Data: IP addresses, user-agent headers, device identifiers, connection logs, and crash metrics.
3. Sensitive Data and Emotional Well-Being Content
Given the community nature of the service, your voluntary contributions may disclose sensitive categories of data (mental health concerns, sexual orientation, religious beliefs). By posting, you consent to our processing of this data strictly to deliver platform features. Help My Mind does not sell your personal data or use emotional health content to build personalized behavioral advertising profiles.
4. Anonymous Venting and Technical Boundaries
The "Anonymous Venting" feature conceals your public identity from other users. HOWEVER, WE DO NOT GUARANTEE ABSOLUTE TECHNICAL ANONYMITY. Help My Mind retains connection logs and IP addresses linked to originating accounts. These logs are accessed only to mitigate fraud or life-threatening harm, and will be shared with judicial or law enforcement authorities upon lawful process.
5. Child Protection, Age Eligibility, and Child Safety Standards
The Service is not intended for individuals under 14 years of age. Users between 14 and 18 years of age must use the platform under parental supervision, pursuant to GDPR (Article 8), CCPA/COPPA, and Brazilian LGPD. Help My Mind maintains an absolute zero-tolerance policy against any form of Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). Data processing for the purpose of preventing abuse, removing illegal content, preserving digital evidence, and reporting to law enforcement (including NCMEC and police authorities) is conducted under legal obligation and vital public interest grounds. 6. Legal Bases for Data Processing
We process personal data under: (a) Performance of Contract (delivering the service and Premium subscriptions); (b) Legal Obligations (mandatory log retention); (c) Vital Interests (emergency risk mitigation); (d) Legitimate Interests (security, abuse prevention, and quality); and (e) Consent (where required for non-essential cookies).
7. Data Sharing and Third Parties
HELP MY MIND DOES NOT SELL YOUR PERSONAL DATA. Data is shared only to the extent necessary with: Cloud infrastructure providers, cybersecurity vendors, and payment processors bound by strict Data Processing Agreements (DPAs). Law enforcement authorities in response to valid court orders, subpoenas, or to prevent imminent physical harm. Corporate successors in the event of a merger, acquisition, or restructuring.
8. Healthcare Professionals: Independent Controllers
Help My Mind provides technological directory infrastructure only. Any healthcare professional contacted through the platform acts as an Independent Data Controller. Professional confidentiality and clinical records are the sole responsibility of the practitioner.
10. International Data Transfers
Personal data may be processed on servers located internationally under Standard Contractual Clauses (SCCs) and equivalent safeguards.
11. Data Retention and Account Deletion
We retain personal data while your account remains active or as needed for statutory obligations. Upon account deletion, public content is anonymized or removed, with residual backups purging within 90 days.
12. LIMITATION OF LIABILITY CONCERNING SECURITY
WE IMPLEMENT REASONABLE TECHNICAL AND ORGANIZATIONAL SAFEGUARDS. HOWEVER, THE SERVICE IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELP MY MIND DISCLAIMS LIABILITY FOR UNAUTHORIZED ACCESS RESULTING FROM ADVANCED CYBERATTACKS EXCEEDING COMMERCIALLY REASONABLE DEFENSES.

14. Severability
